1. Who we are

2. Who can become a member

You must be at least 18 years old, live in Switzerland, and be able to enter into a binding agreement. A membership is personal: one membership per person and per email address. It cannot be shared, transferred or resold.

You agree to give us accurate information, including your name, email address and sizes, and to keep it up to date.

3. Joining: invitations, numbers and the waitlist

Memberships are limited by capacity, so that each experience with us stays curated and enjoyable. Members join in waves:

• Numbers 1 to 80 are founding memberships, available only through a personal invitation link from us. Each link can be used once, by the person it was sent to, and expires once used. It cannot be passed on.
• From number 81, memberships open to the public once all founding numbers belong to paying members, and then as capacity allows. We open new closets as our waitlist grows, so our capacity grows with demand. Until a place is free, you can join the waitlist.

Your member number is assigned by us, in order of confirmed payment, as the lowest free number in the wave you join. It identifies your membership and sets your price (section 4). It has no monetary value and cannot be chosen, exchanged or transferred.

When you continue to payment, we hold a number for you while you pay. If payment is not completed in time, the hold lapses and the number may go to someone else.

Your membership starts, and the contract between you and us is formed, when your first payment is confirmed. We confirm it by email.

Joining the waitlist is free, creates no obligation for you or for us, and does not guarantee a membership, a number or a price.

4. Price and payment

• Prices are in Swiss francs. NMBRD is not registered for VAT, so no VAT is charged.
• Your first payment is taken when you join. After that, you are billed every month on the same date, automatically, to the payment method you gave us. Payments are processed by our payment provider, Stripe.
• Your price is kept for as long as your membership runs without interruption. If you cancel and join again later, you join at the price in force on that day.
• We may change the prices offered to new members at any time. This does not affect the price of an existing membership.
• If a payment fails, we will let you know and try again. Until the payment goes through, we may pause your borrowing and invitations. If it is still unpaid 14 days after the due date, we may end your membership (section 11).

5. What your membership includes

The membership is the same for all members. Each membership includes:

• personal invitations to our members' private events. Until our first closet opens, we hold one every month, where selected brands, content creators and curators open their closets. Places are limited by capacity, and invitations are personal;
• one credit, which allows you to borrow one piece at a time from across our curated selection (section 6);
• your personal key to all closets we open in Zürich. We plan to open the first in 2027. Opening dates are our target, not a promise;
• professional cleaning of every piece you borrow.

We may change the date, place or format of an event. When an event is cancelled or moved, your membership continues unchanged.

6. Credits and additional subscriptions

• One credit means one piece out at a time. Any piece counts as one: we make no difference between a jacket and a pair of shoes.
• Credits are not money. They cannot be saved up, carried over, exchanged for cash, shared or transferred.
• Once our first closet opens, you can top up with an additional subscription, on top of your membership: CHF 29 per month for 2 additional credits, CHF 69 per month for 6 additional credits, or CHF 89 per month for 10 additional credits. Additional subscriptions are billed monthly with your membership and can be cancelled on their own, effective at the end of the month paid for.

7. Borrowing

• Until our first closet opens, you borrow at our members' events and bring the piece back at a later one, then pick again. Once a closet is open, you can swap whenever you walk in.
• There is no time limit on how long you keep a piece while your membership is active.
• Pieces are available while they last. We cannot guarantee that a particular piece, size or brand will be available.
• Every piece remains the property of NMBRD or of the brand, content creator or curator who lent it to us. Ownership never passes to you.
• Pieces are for your personal use only. You may not sell, rent, lend or give them to anyone else.
• Please do not alter, tailor, repair, wash or dry clean a piece yourself, or remove its labels or tags. Cleaning is included, and we take care of it.
• Every piece is shared within our community. We ask you to treat each one as your own, knowing the next member is already waiting for it.

8. Damage and Damage Protection

Accidents still happen. If something goes wrong, let us know within 24 hours and send us a photo; telling us early always makes things easier.

• Minor damage, like a stuck zip, a loose button, a missing bead or a small stain, can usually be repaired or cleaned. If you added Damage Protection, it is covered up to CHF 80. If you did not, we charge you the actual repair or cleaning cost.
• If a piece is seriously damaged and cannot be restored, we charge you its replacement value. We base that on the piece's current market value, age and condition, and it is never more than the original retail price.

Damage Protection

Damage Protection is an optional add-on for high-value pieces, which you can choose when you borrow, for CHF 8 per rental. It covers repairs and specialist cleaning for minor, fixable damage, such as broken zips, clasps or closures, missing beads or a small stain, up to CHF 80 per rental. It does not cover pieces that are lost, stolen or damaged beyond repair, or repair costs above that limit. In those cases, the piece's replacement value applies.

9. Loss, theft and pieces not returned

• If a piece is lost or stolen, tell us straight away. We charge you its replacement value, worked out as in section 8.
• If you cancel your membership, please return every piece you hold before your membership ends.
• If a piece still has not been returned 30 days after your membership end date, we consider it lost. We then charge the full retail price to your payment method, on top of any outstanding fees. Unpaid amounts may be passed on to a collection agency.

10. Charges for damage, loss and non-return

You authorise us to charge the payment method linked to your membership for the amounts described in sections 8 and 9. Before we charge you, we tell you the amount and the reason by email, and you have 7 days to reply if you disagree.

11. Cancelling and ending a membership

If you cancel

• You can cancel at any time from your account, with no minimum term.
• Your membership runs until the end of the month you have paid for. We do not refund part months.
• Please return every piece you hold before your membership ends (section 9).
• Once your membership ends, your price is no longer kept (section 4).

If we end or pause it

We may pause or end your membership, with notice by email, if you seriously or repeatedly breach these Terms, for example if a payment stays unpaid, if pieces are misused, sold or not returned, if you behave disrespectfully towards members, our team or our partners, or if you give false information. In serious cases, we may end it immediately.

If we end your membership without any fault on your part, or stop the Service altogether, we refund the unused part of any period you have already paid for.

12. At our events and in our closets

• Invitations and keys are personal. Please do not bring guests unless your invitation says so.
• Please treat other members, our team and our partners with respect, and follow our team's instructions on site.
• Our events may be photographed or filmed, and the images used on NMBRD's channels. If you prefer not to appear, tell our team on the day or write to us, and we will respect it.
• Any alcohol served at our events is for guests aged 18 and over.

13. Your profile, sizes and how we curate

After you join, we ask for the sizes you reach for and what you love, and we learn from every interaction, every email, every text you answer. We use this to curate our selection and to suggest pieces to you, as described in our Privacy Policy.

Some suggestions and summaries may be generated with the help of AI. They are inspiration, not professional advice, and may not always be accurate or to your taste.

14. Using our website

• Do not misuse, disrupt or try to gain unauthorised access to the Service, or use it for any unlawful purpose.
• The NMBRD name, branding, design, text, images and software belong to us or our licensors. You may use the website for your personal, non-commercial use only. You may not copy, scrape or reproduce any part of it without our written permission.
• We provide the website as it is and as available. We may change, suspend or discontinue parts of it, including the waitlist, at any time.

15. Liability

To the fullest extent permitted by Swiss law:

• we are not liable for indirect or consequential loss arising from your use of the Service;
• we are not liable for decisions you make based on suggestions or AI-generated content;
• nothing in these Terms excludes or limits liability that cannot be excluded by law, including for unlawful intent or gross negligence, or for death or personal injury.

16. Privacy

How we handle your personal data is described in our Privacy Policy, which forms part of these Terms.

17. Changes to these Terms

We may update these Terms as NMBRD grows. We post the new version here and change the "Last updated" date. For changes that matter to members, we email you at least 30 days before they take effect; if you do not agree, you can cancel before then. Changes never affect the price kept for your membership.

18. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

The courts of Zürich, Switzerland have exclusive jurisdiction, subject to any mandatory consumer protection rules of the country where you live that allow you to bring proceedings in your local courts.
